New York’s One-Year Window is Now Open for Adult Survivors

In the State of New York, victims of child sex abuse have been able to seek recourse under the Child Victims Act. If the abuse occurred after the age of 18, however, a different statute of limitations applied, and victims had a shorter period to bring a civil case. Moreover, the window to bring a claim varied on the type of abuse perpetrated. This limited recourse for adult victims of abuse and prevented many from obtaining justice.

On March 24, 2022, New York Governor Kathy Hochul signed the Adult Survivors Act into law. The Adult Survivors Act opens a 1-year window for adults that experienced abuse after the age of 18. This window opened on November 24, 2022, and will close on November 24, 2023. This brief window will go a long way to helping adult victims of sex abuse receive the compensation they need and continue on the path toward healing.
